What is Personal Data?

Special category data is Personal Data that needs more protection because it is sensitive. This includes Personal Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, and biometric data. As well as, data concerning health, a person’s sex life; and a person’s sexual orientation. In order to lawfully process Special Category Data, it is necessary to consent to the processing.

What is processing?

"Processing" means any operation or set of operations which is performed upon Personal Data, whether or not by automatic means. The term is broad and covers virtually any handling of data.

What are the legal bases of processing?

In accordance with the DPA and the GDPR, we have to have at least one of the following legal bases to process your Personal Data:

  • For the fulfilment of contractual obligations
    1. The purposes of the data processing are primarily based on the service we provide.
  • Within the framework of our legitimate interests

    Where necessary, we process your data beyond the actual performance of the contract in order to safeguard legitimate interests of us or third parties. Examples are:

    3. Defence against third-party claims and enforcement of own claims.

DATA WE COLLECT AUTOMATICALLY

Log data

Each time you visit our Platform, our system automatically records the following data from the visiting device and stores it in a so-called log file: i) Name of the retrieved file, ii) date and time of the visit, iii) amount of data transferred, iv) message about successful retrieval, type of browser and version used, v) IP address (identification of the user's device), vi) Operating system of the visiting device, vii) Internet service provider of the visiting device, viii) website from which you access our Platform, and ix) which of our Platform pages you are accessing. The legal basis for processing is our legitimate interest.

Cookies

We use so-called cookies on our Platform. Cookies are pieces of information that are transmitted from our web server or third-party web servers to your web browser and stored there for later retrieval. For further information on the Cookies we use, please refer to our Cookie Policy. The legal basis for processing is our legitimate interest and your consent.

Our Platform uses a cookie consent tool to obtain your consent to the storage of cookies and to document this consent. Contacting us

Personal data is processed depending on the contact method. In addition to your name and email address, IP address, or phone number, we usually collect the context of your message, which may also include certain Personal Data. The personal data collected when you contact us is used to process your request, and the legal basis is your consent.

Providing our Platform

The protection of your data is particularly important to us in the performance of our own services. We therefore only want to process as much Personal Data as is absolutely necessary. Nevertheless, we rely on the processing of certain Personal Data, to fulfil our contractual obligations to you or to carry out pre-contractual measures.

Registration

If you register on our Platform, we will request mandatory and, where applicable, non-mandatory data in accordance with our registration form. Your data will remain stored for as long as the registration lasts, in particular if the storage is necessary for the fulfilment/execution of the contract, to enforce our rights or for our other legitimate interests, or if we are required by law to retain your data (e.g., within the framework of tax retention periods).

Profile

As a registered user, you have the opportunity to create a user profile with just a few clicks and details, and the relevant profile data you provide will be posted on your profile. Of course, you can change the information at any time via the settings in your profile. You have choices about the information on your profile. You don’t have to provide additional information on your profile; however, profile information helps you to get more from our services. It’s your choice whether to include sensitive information on your profile and to make that sensitive information public. Please do not post or add Personal Data to your profile that you would not want to be available. The legal basis for the processing of your Personal Data is the establishment and implementation of the user contract for the use of the service. We store the data until you delete your user account. Insofar as legal retention periods are to be observed, storage also takes place beyond the time of deletion of a user account.

Courier Registration

The following Personal Data is collected from Couriers that want to sign up with us and provide their services on our Platform:

  • Proof of Identity (Passport or UK Driving Licence): To confirm your identity.
  • Right to Work in the UK (Visa or Work Permit (for non-UK nationals)): To confirm your right to work in the UK. (UK nationals can provide a Passport or Birth Certificate).
  • Driving Licence (A full UK driving licence).
  • Vehicle Documents
  • Vehicle Insurance: Must include Hire and Reward insurance, which covers the use of your vehicle for commercial deliveries.
  • Vehicle Registration Document (V5C): The logbook proving ownership of the vehicle
  • MOT Certificate (for vehicles over 3 years old): To confirm the roadworthiness of your vehicle.
  • Road Tax: Proof that your vehicle is taxed and road-legal.
  • Proof of Insurance
  • Goods in Transit Insurance: To cover the parcels you're delivering in case of loss, damage, or theft.
  • Public Liability Insurance: This protects you in case of an accident involving a third party while delivering
  • Proof of Address (Utility Bill or Bank Statement: To verify your address (usually from the last 3 months)).
  • Criminal Background Check (DBS Check) Some courier companies may require you to pass a Disclosure and Barring Service (DBS) check.
  • Self-Employment Registration (You’ll need to register as self-employed with HMRC and obtain a Unique Taxpayer Reference (UTR)). This is important for tax purposes, as you’ll be working as an independent contractor.
  • Bank Account Details (A UK bank account for receiving payments).
  • Contact Details
Purchases and Courier pay out

When ordering services, it is necessary, among other things, to provide your name, email address, and postal address and, if applicable, your payment data. Payment by credit card and debit card and Courier pay out are made via the Payment Gateways of Stripe. Payment data will solely be processed through Stripe and we have no access to any Payment Data you may submit. The legal basis for the provision of a payment system is the establishment and implementation of the contract.

Using our Platform and providing Content

If you wish to use our Platform and its features, we process the Personal Data you voluntarily provide for the purpose of providing your Platform. In addition, depending on how you use our Platform, you may also provide Content such as text and images etc.

While we need certain Personal Data to allow you to participate on our Platform your Personal Data is never shared without a lawful reason. However, Content uploaded by will be made available and may be viewed and otherwise accessed by others. In turn, we may process:

Content

Content Data includes photos, videos, text messages, or other digital content you create, broadcast, perform, or upload on our Platform and information about the content you create, broadcast, perform, or upload, including metadata that is provided with that content. Please remember that Content Data that you transmit may reveal personal data about yourself as well, including identifying information about yourself depicted in any photos or videos.

Personal Data

Personal Data you provide may be considered “special” or “sensitive”. This includes Personal Data concerning for example your racial or ethnic origins, sexual orientation, sexual preferences and gender. By choosing to provide this data, you consent to our processing of that data. You have choices about the data you provide and how you share it. You don’t have to provide Personal Data or Special Category Data. It’s your choice whether to include Personal Data or Special Category Data and to make that information available to us. Please do not share information that you would not want to be available. The legal basis for the processing of your Personal Data and Special Category Data is the establishment and implementation of the user contract for the use of the service as well as your consent.

Images and facial-related information

In providing our Platform and publishing your content including video, images, chats we may process images and facial-related information from our Users. Images and facial-related information are used and processed solely for the purpose explicitly consented to and we do not collect, use, or store any images and facial-related information for the purpose of recognising faces outside of this purpose. The legal basis is your consent.

Chats and communications

Of course, we also process your chats and communications with other users as well as the content you may provide to others through our Platform as you interact with them.

The legal basis for providing the above is the fulfilment of the user contract for the use of the website as well as your consent.

Reviews

Within your review, you may be able to display certain information, share certain details, exchange knowledge and insights, and post and view relevant content. Content and data are publicly viewable. You have choices about the information in your review. You don’t have to provide additional information on your review. It’s your choice whether to include sensitive information in your review and to make that sensitive information public. Please do not post or add Personal Data in your review that you would not want to be available.

Service Notifications

By using our services, you are giving your consent to receiving notifications and messages per email. Those typically include general, profile, and content information in relation to your use of our Services. Our system notifications are designed to enhance your experience. You can, of course, opt out of receiving notifications by following the unsubscribe instructions at the bottom of every notification email sent by us. The legal bases are to provide you with our services and your consent, as well as our legitimate interest.

Administration, financial accounting, of ice organisation, contact management

We process data in the context of administrative tasks as well as organisation of our business, and compliance with legal obligations, such as archiving. In this regard, we process the same data that we process in the course of providing our contractual services. The processing bases are our legal obligations and our legitimate interest.

Newsletter

If you have consented to receive our newsletter, we will use your email address and, if applicable, your name to send you information about us, our services, promotions, and news. You can revoke your consent to receive the newsletter at any time with effect for the future. You will find the unsubscribe link at the end of each newsletter. The revocation leads to the deletion of the collected user data. The legal basis is your consent as well as our legitimate interest.

We also collect information about your activities on our Platform, such as how you use them (e.g., the date and time you logged in, features you used, searches you performed, clicks and pages you were shown, content you clicked on) and how you interact with other users (e.g., users you connect and interact with, the time and date of your exchanges). The legal basis is the fulfilment of the user contract for the use of the website as well as your consent.

Aggregated Data

We also collect, use, and share aggregated data such as statistical or demographic data, for any purpose including improving my website. Aggregated Data could be derived from your Personal Data but is not considered Personal Data in law as this data will not directly or indirectly reveal your identity. However, if we combine or connect aggregated data with your Personal Data so that it can directly or indirectly identify you, we treat the combined data as Personal Data which will be used in accordance with this policy.

GENERAL PRINCIPLES

Who receives my data?

Within Zuboid Courier, those that need your data to fulfil our contractual and legal obligations will receive access to it.

Processors used by us may also receive data for these purposes. These are companies in the categories of IT services, telecommunications, and sales and marketing. Where we use processors to provide our services, we take appropriate legal precautions and corresponding technical and organisational measures to ensure the protection of personal data in accordance with the relevant legal provisions.

Data is only passed on to third parties within the framework of legal requirements. We only pass on users' data to third parties if this is necessary, for example, for contractual purposes or on the basis of legitimate interests in the economic and effective operation of our business, or you have consented to the transfer of data

How long will my data be stored?

As far as necessary, we process and store your personal data for the duration of our business relationship, which also includes, for example, the initiation and execution of a contract.

In addition, we are subject to various storage and documentation obligations, which result from the minimum statutory retention periods HMRC and Companies House, among others. The retention and documentation periods specified there are two to eleven years.

How do we secure your data?

Our Platform uses SSL or TLS encryption to ensure the security of data processing and to protect the transmission of content or contact requests that you send to us. We have also implemented numerous security measures (“technical and organisational measures”) for example, encryption or need-to-know access, to ensure the most complete protection of Personal Data processed through this website.

And databases or data sets that include Personal Data may be breached inadvertently or through wrongful intrusion. Is data transferred to a third country or to an international organisation?

We do not normally transfer Personal Data to countries outside the UK and the EEA. However, if we do, we ensure that the processing of your Personal Data is governed by processing contracts that include standard contractual clauses to ensure a high level of data protection.

ADVERTISING

We would like to show you interesting advertising outside of our Platform and use various third-party tools and cookies for this purpose. These collect and process information about your activities on our Platform - for example, which products you are interested in or which pages you visit. By knowing what you are looking for and how you use our Platform, we can adapt our advertising to your needs. And thus increase the likelihood that you will also be shown suitable and interesting advertising outside our Platform.

We are present on social media on the basis of our legitimate interest. If you contact or connect with us via social media, we and the relevant social media website are jointly responsible for the processing of your data and enter into a so-called joint controller agreement. The Personal Data collected when contacting us is to handle your request, and the bases are both your consent and our legitimate interest.

Market research and advertising

In addition, your data may be processed for market research and advertising purposes. For example, usage profiles can be created from your usage behaviour and the resulting interests. This allows, for example, advertisements to be placed within and outside the websites that presumably correspond to your interests. The legal basis is our legitimate interest.

When you visit our profiles and interact with us and others

When you visit our social media profiles, we, as the operator of the profile, process your actions and interactions with our profile (e.g., the content of your messages, enquiries, posts, or comments that you send to us or leave on our profile or when you like or share our posts) as well as your publicly viewable profile data (e.g., your name and profile picture). Which Personal Data from your profile is publicly viewable depends on your profile settings, which you can adjust yourself in the settings of your social media account. The legal basis is our legitimate interest and your consent.

You can revoke consents you have given at any time by contacting us. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Access Request

In the event that you wish to make a Data Subject Access Request, you may inform us in writing of the same. We will respond to requests regarding access and correction as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days, we will tell you why and when we will be able to respond to your request. If we are unable to provide you with any Personal Data or to make a correction requested by you, we will tell you why.

Complaint to a supervisory authority

You have the right to complain about our processing of Personal Data to a supervisory authority responsible for data protection. The Information Commissioner's Office (ICO), which is the relevant authority in the UK.
